WORKERS COMPENSATION TRIBUNAL RULES 2009: RULE THIRTY - COSTS OF PROCEEDINGS

His Honour Judge Jennings, President of the Workers Compensation Tribunal, has amended Rule 30 - Costs of Proceedings by deletion of the scale of counsel fees from
sub-rule (7)(d) and deletion of sub-rules (7)(e), (8) and (9), to commence on and from 16 January 2012.

The result of the deletion of the scale of counsel fees from
sub-rule 30(7)(d) is that when the Tribunal determines the amount of costs as between the parties, payable by one party to the other for counsel fees, no longer will the hourly rate be on a reducing scale as the amount of time spent increases. Instead, the guide to rates for counsel fees that should be allowed will be taken from the Supreme Court scale for counsel fees. Rule 30(8) and 30(9) were deleted because they were only applicable when the above scale was present.
